Terms of Service

These Terms of Service ("Terms") govern your access to and use of KyroStat's website and web application (the "Service") provided by KyroStat ("KyroStat", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Note: the operating legal entity and the specific governing-law jurisdiction below are placeholders to be finalised, and these Terms should be reviewed by qualified counsel before you rely on them.

1. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract. You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it up to date.

2. The Service

KyroStat helps you run statistical analyses: you upload data, receive AI-assisted recommendations for tests and plots, run them on Python and R, and receive results, plots, code, and reports. The Service is currently offered in beta and may change, and features may be added or removed.

3. Acceptable use

You agree not to:

• Upload data you do not have the right to use, or that is unlawful or infringing.
• Upload malicious code, or attempt to break out of the execution sandbox, disrupt, or gain unauthorised access to the Service or other users' data.
• Reverse engineer, resell, or misrepresent the Service, or use it to build a competing product.
• Use the Service to violate any law or the rights of others.

4. Your data and content

You retain all rights to the data and content you upload. You grant us a limited licence to host, process, and display your content solely to operate and provide the Service to you (for example, running your analyses and generating your reports). Our handling of personal data is described in the Privacy Policy.

5. AI-generated results: no guarantee, verify before you rely

The Service uses artificial intelligence to recommend tests and generate code. AI outputs are probabilistic and may be incomplete, inaccurate, or inappropriate for your data or research question. KyroStat is a tool to assist analysis, not a substitute for professional statistical judgement. You are responsible for reviewing and independently verifying every result, and for any decision, publication, or submission you base on it. We do not warrant that any result is correct, fit for a particular purpose, or suitable for a specific journal or standard.

6. Third-party services

The Service relies on third parties, including our AI provider (Anthropic), hosting provider, analytics providers, and, for paid plans, a payment processor. Your use may be subject to their terms, and we are not responsible for their acts or omissions.

7. Subscriptions and billing

Some features may require a paid subscription. Where paid plans apply, prices, billing cycles, and refund terms will be presented at purchase. During beta, the Service or parts of it may be provided free of charge, and we may introduce charges with notice.

8. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by KyroStat and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service under these Terms.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of results, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, KyroStat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service, including any reliance on AI-generated results. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.

11. Indemnification

You agree to indemnify and hold KyroStat harmless from claims arising out of your data, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, and the courts of England and Wales will have jurisdiction, unless a different jurisdiction is required by applicable law. (This governing-law choice is a placeholder to be confirmed with counsel and updated to the operating entity's jurisdiction.)

14. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
